Definitions

The following definitions will help clarify some terminology on our site. Please feel free to contact us if any confusion remains.

Art Print Prints that are available for purchase to hang in your home or office as artwork. You can purchase any of our images as art prints. You are not allowed to reproduce these prints in any form without purchasing the right to do so.

Company Represented is the company whose product or service oversees the "End User". In some self promotion cases, this entity may be the same as the "End User". This is usually associated with Rights Managed licensing. Example: 'Fordly Motor Company' would be the Company Represented for a purchase of an image for the end user 'Fordly Sedan'. The Company Represented is defined by the purchaser during the check out process.

Copyright is the unencumbered use of property. The copyright is always owned by the creator of property until legally relinquished by the owner. Our photographers own the copyrights to their images until they sell that right. Colorado Image is the agent that assigns, or licenses, the use-rights on behalf of the photographers. Penalties of up to $100,000 are awarded for copyright infringement. Please ask before purchasing if you are not sure of the rights that you are purchasing from this site.

End User The Use-License for some image licenses (such as Rights Managed) is limited to use by a single "End User". The End User is the entity that benefits from their association with the photo license purchased. This could be a product name, ad campaign, a web site URL or a person within an organization, etc. In general it is the entity for which there is no further subdivision. For example if the photo is to be used on an advertising poster for Joe's Light Beer made by Joe's Brewery, the End User is 'Joe's Light Beer', not Joe's Brewery. If web-site-only rights are purchased, the End User is the URL of the home page, of the site. You do not need to worry about this with Royalty-free image licensing.

File Size is the number of megapixels that the uncompressed file takes on the server or your computer. File size is limited by the size of the original media on which the photograph was captured, and the density of the scan. We license several sizes of files. Each file size has specifications as the dots per inch (dpi) and the overall size that it will print at 300 dpi (an accepted standard for quality printing on an offset or digital press). For example you will see specifications such as 56MB/300 dpi/12" x 18" on this site. This means that the image takes up 56 MegaBites of computer disk space (when uncompressed), allows for 300 dots of ink per inch of printed material, and will yield a minimum print size of 12" x 18" at 300 dpi.

On our site, the image in the foregoing example is 56MB in an RGB (Red, Green and Blue) color environment. For output, your graphic designer will convert the image to print ink colors of CMYK (Cyan, Magenta, Yellow and Black), which will inflate the file size without harming the quality of the image. Images that arrive to you in jpg format, have been compressed for shipping. When opened in a photo editing program such as Adobe Photoshop, they can be saved as a tiff file to regain their full file size.

License or Use-License refers to the method that we transfer rights to use images. Images are generally licensed not purchased from this site. The industry calls this assignment of rights "Licensing" or purchasing a "Use License". Licensing varies greatly from site to site be sure you read the license agreement for each purchase so that you know how you are allowed to use an image. You can purchase the original copyrights from the photographers in most cases if you feel you want to own the image. The individual photographer will set the price.

Piracy is infringement of copyright law by illegally downloading and using all or a portion of an image, including thumbnail and "comp" images. Typical damages are $100,000 or more.

Rights Managed means that the End User's rights to use the image are strictly limited. Every site has it's own rules as to what rights they are selling with the photographs. Our images are limited to a single End User, a defined distribution number, with a time limit for use. The use period and distribution can be extended by re-purchasing the rights.

Rights Protection refers to various assignment of rights whether you are talking about the photographer or the purchaser of rights. On this site, we do not currently offer Rights Protection.

Royalty-Free means you can use the images for any use not prohibited in the license without further fee. You may not distribute copies of the images, only the items created with the images.

Use Period refers to the amount of time a purchaser or End User has to make use of an image. If you purchase a license for a Rights Managed image, the named End User has the right to print the image for a specific time period.
